Fact Finding Hearing is a formal trial in the presence of a judge, commissioner, or master. In such a hearing, witnesses may be present to testify, to determine if the allegations are true. The following is an example of a state statute (New York) defining the term: According to NY CLS Family Ct Act § 301.2, "Fact-finding hearing" means a hearing to determine whether the respondent or respondents committed the crime or crimes alleged in the petition or petitions.
